Appeals to TDSAT

Section 29 of the DPDPA designates the Telecom Disputes Settlement and Appellate Tribunal (TDSAT) as the appellate body for orders of the Data Protection Board. Any person aggrieved by an order of the Board may prefer an appeal to TDSAT within the prescribed period. The choice of TDSAT leverages existing adjudicatory infrastructure with expertise in technology-related disputes. This avoids the need to create a new appellate body and ensures that appeals are heard by a tribunal familiar with digital and technology issues.

Appeals to TDSAT may be filed on any ground - questions of fact, law, or mixed questions of fact and law. TDSAT may confirm, modify, or set aside the order of the Board. It may also remand matters back to the Board for fresh consideration. The broad scope of appeal ensures effective oversight of Board decisions and provides a meaningful remedy to aggrieved parties. TDSAT's powers include the ability to review the penalty quantum, the factual findings, and the legal interpretation applied by the Board.

Section 29(2) of the DPDPA fixes the limitation period for an appeal at sixty days from the date the Board's order is received, with TDSAT empowered to condone the delay on sufficient cause. Rule 22 does not itself set this or any other limitation period; it prescribes only the digital filing format and a fee equivalent to the fee charged under the TRAI Act, 1997 for a similar proceeding. TDSAT otherwise follows its established procedural rules, which provide for exchange of submissions, hearing of arguments, and pronouncement of orders. TDSAT may grant interim relief, including stay of Board orders, pending disposal of the appeal. This is significant for organisations facing substantial penalties or restrictive directions that may affect ongoing operations.
